Terms of Service

Please read these Terms carefully before using Crest. By using our platform you agree to be bound by them.

The short version: Crest is non-custodial — we never hold your keys or funds. We provide a software interface only. Crypto is risky, staking has lockups, and nothing here is financial advice. Use the platform responsibly.

1. Acceptance of Terms

By accessing or using the Crest platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Crest Labs ("Crest", "we", "us", or "our"). We may update these Terms from time to time with reasonable notice.

2. Eligibility

You must be at least 18 years of age to use the Service. By using Crest, you represent and warrant that you are of legal age and that your use of the Service does not violate any applicable law or regulation in your jurisdiction. Residents of jurisdictions where the Service is restricted or prohibited are not permitted to use Crest.

3. Nature of the Service

Crest is a non-custodial crypto asset management platform built on the Avalanche blockchain. We provide tools for vault management, staking, goal-based savings, automation rules, and an AI-powered financial assistant. Crest does not hold, control, or have access to your private keys or crypto assets. All on-chain interactions are executed by your wallet directly. We are a software interface, not a financial institution, bank, broker, or investment advisor.

4. Non-Custodial Model

Crest operates a strictly non-custodial architecture. This means: (a) you retain full control of your wallet private keys at all times; (b) Crest cannot access, freeze, or move your funds without your explicit on-chain authorisation; (c) if you lose access to your wallet or seed phrase, Crest cannot recover your assets; (d) you are solely responsible for the security of your wallet credentials. By using Crest, you acknowledge and accept these risks.

5. Not Financial Advice

Nothing on the Crest platform constitutes financial, investment, legal, or tax advice. All projections, APY estimates, reward calculations, AI chat responses, and automation suggestions are informational only. Past performance of staking yields or asset values does not guarantee future results. You should consult a qualified financial advisor before making any investment decisions. Crypto assets are highly volatile and you may lose some or all of your invested capital.

6. Blockchain Risks

You acknowledge and accept the following risks inherent to blockchain-based services: (a) blockchain transactions are irreversible once confirmed; (b) network congestion may delay or fail transactions; (c) smart contract bugs or exploits may result in loss of funds; (d) regulatory changes may affect the availability of certain features; (e) the Avalanche network may experience outages, forks, or protocol changes outside of Crest's control. Crest is not liable for any loss arising from these risks.

7. Staking & Lockup

Staked AVAX is subject to lockup periods as selected by you. During the lockup period, staked assets cannot be withdrawn or restaked under any circumstances, including platform downtime or emergency situations. Staking rewards are estimates based on current validator performance and network conditions and are not guaranteed. Validator uptime affects actual rewards received.

8. AI Chat & Automation

The Crest AI assistant is powered by large language models and may produce inaccurate or incomplete information. Do not rely on AI responses as your sole basis for financial decisions. Automation rules execute on your behalf based on conditions you define. You are responsible for reviewing and monitoring all active automation rules. Crest is not liable for losses resulting from automation rules executing as programmed but producing unintended outcomes.

9. Prohibited Activities

You agree not to use Crest to: (a) violate any applicable law or regulation, including anti-money laundering (AML) and sanctions laws; (b) use the platform for illicit or fraudulent purposes; (c) attempt to reverse-engineer, exploit, or attack the platform or its smart contracts; (d) circumvent geographic restrictions; (e) impersonate any person or entity; (f) engage in market manipulation or wash trading. We reserve the right to suspend accounts found in violation of these prohibitions.

10. Intellectual Property

All content, design, code, branding, and materials on the Crest platform are the exclusive property of Crest Labs and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works from any Crest materials without prior written consent.

11. Limitation of Liability

To the maximum extent permitted by law, Crest Labs, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of crypto assets, loss of data, or loss of profits, arising from your use of the Service, even if Crest has been advised of the possibility of such damages. Our total aggregate liability to you for any claims arising under these Terms shall not exceed USD $100.

12. Indemnification

You agree to indemnify and hold harmless Crest Labs and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may discontinue use of the Service at any time. Upon termination, your right to use the Service ceases immediately. As Crest is non-custodial, termination does not affect your ability to interact directly with your wallet on-chain.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Crest Labs is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by local law.

15. Changes to Terms

We may modify these Terms at any time. We will provide at least 14 days' notice of material changes via email and in-app notification. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.
